SENSITIVE HEALTH INFORMATION
Across the range of support provided to clients, nutritionists/coaches will be provided personal and confidential information such as contact information, lifestyle patterns and habits, family histories and detailed medical information. In Australia we are bound by the Privacy Act 1988, which regulates the handling of personal information and is underpinned by thirteen Australian Privacy Principles (APP), which govern the collection, processing, storage, protection, and dissemination of personal information relating to all clients.
This means that all information is confidential and is not to be discussed with anyone, except for other health professionals who are currently treating or are being referred to treat a client, and only after consent is obtained.
The only exception is where the client’s safety is at risk, such that confidentiality agreements may jeopardise safety, and a nutritionist/coach is obligated to inform appropriate personnel. This is called ‘mandatory reporting’ in situations where:
A client or someone else is at risk of harm
A client discloses criminal activities
Courts subpoena a nutritionist/coach’s notes or disclosures.
STORAGE OF SENSITIVE HEALTH INFORMATION
Health and medical information is more sensitive than other information collected. For this reason, the Splose practice management software was chosen due to its compliance with the Australian Privacy Principles set out in the Privacy Act 1988 (Cth) (Privacy Act), Privacy Act of 1974 (US Privacy Act), Health Insurance Portability and Accountability Act of 1996 (HIPAA), Children’s Online Privacy Protection Act (COPPA), California Consumer Privacy Act (CCPA), the General Data Protection Regulation (EU) 2016.679 (GDPR) and the UK General Data Protection Regulation (UK GDPR) (collectively, the Applicable Privacy Laws).
Sensitive information will be collected by more secure methods including:
